The different aspects of the process of recognition of the identity and rights of the quilombolas are used as factual elements of reflection on the classic conceptions of human rights. They also serve as elements for verifying the hypothesis according to which the theoretical and practical problems relating to the identity and the right of the quilombolas are not considered by the universalist conceptions that seek to explain the effectiveness of human rights. In Rio de Janeiro, the struggle of the Quilombola Community Sacopã for the recognition of the right to land operates as a condition of the questioning of the universalist tradition of classical concepts that define human rights as universal rights. Sociology and anthropology are the theoretical framework capable of supporting human rights criticism.
Keywords: Quilombolas, Human Rights, universalism.
