Impacts of the constitutional debate for graduate Law studies in Brazil in the face of challenging public funding crisis

Abstract

This article is concerned with studying the impacts of the Brazilian Constitution of 1988 on the expansion and consolidation of national legal research. The work is guided to show historical recovery and critical academic experience, seeking to achieve greater scientificity and efficiency of the recognized graduate programs in Law. The chosen methodology is empirical and a survey in Lattes Platform was carried out in order to identify the number of researchers records (masters and doctors). The data collected were analyzed annually to identify the rate of growth in Law scientific research. Finally, the study discussed the importance of public funding for the maintenance and operation of the national graduate program system, the current problem on the negative effects of public funding crisis and profound change of the constitutional principle of public education gratuity before the likely approval of the Constitutional Amendment n. 395/14.

Elaine Cristina Francisco Volpato, UFPR

Graduada em Direito pela Faculdade de Direito de Bauru (1997) e é Mestre em Teoria Geral do Estado, pelo  Centro Universitário Eurípides de Marília - UNIVEM (2006). Especialista em Direito Tributário (2002) e Direito Notarial e Registral (2005).  Foi bolsista CAPES e atuou como advogada por mais de dez anos. Atualmente trabalha com as disciplinas de Ciência Política e Direito Administrativo na UNIOESTE - Campus de Foz do Iguaçu-PR. Doutoranda em Direito pela UFPR e membro do Grupo de Pesquisa e-Justiça.
