Law and politics: An essay on the relationship between time and space

Abstract

This article is an essay on the relationship between law and politics, considered from two important variables: time and space. The article proposes, through a reconstructive approach, to foster a discussion guided by the following problem: How do the changing of law’s time and the changing of politics’ space affect the production of justice and the arrangement and actors in the contemporary political scene? More specifically, it analyzes how the turning of law to the future time, through more open and projective legislation, co-determines a new and strong presence in politics, viz. the Judicial Power. In assessing this new arrangement, the essay also incorporates the space factor of politics, that is, how the challenges brought by a global scale politics impact on the internal construction of democracy.
