This article aims to provide doctrinal contributions to the necessary reconstruction of the concept of jurisdiction according to the democratic rule of law, based on the analysis of the interdependent relationship between the concept of jurisdiction and the model of State in which it is exercised. For this reason, the study is developed by examining the way the judicial function is performed in the Liberal State, Welfare State and Democratic State. Finally, it suggests a reconstruction of the concept of jurisdiction in accordance with the principles of a democratic legal system. The research was conducted based on legal-dogmatic, legal-theoretical and legal-sociological methodological aspects. In turn, the methodological generic types used were the historical-legal, legal-descriptive, legal-projective and legal-propositional.
Keywords: jurisdiction, democratic rule of law, judicial power.
