Political rights and presumption of innocence: The Clean Record Act facing the Constitution

Abstract

The present study seeks to analyze the constitutionality of Complementary Law nº 135/10 (Clean Record Act). Two issues are studied: First, the presumption of innocence principle, and second, the relevance of political rights in the Brazilian Federal Constitution. The study concludes that Clean Sheet Law contains several unconstitutional articles.

Draiton Gonzaga de Souza, PUC/RS

Draiton Gonzaga de Souza é Bacharel em Filosofia e em Direito. Realizou o mestrado em Filosofia e em Direito. Concluiu o doutorado em Filosofia pela Universidade de Kassel (Alemanha), em 1998, com bolsa CAPES-DAAD. Realizou pós-doutorado na Universidade de Tübingen (Prof. Dr. Otfried Höffe) e no Hegel-Archiv, da Universidade de Bochum (Prof. Dr. Walter Jaeschke), como bolsista da Fundação Alexander von Humboldt. Recebeu, em 2002, prêmio do DAAD, e, em 2013, da Fundação Alexander von Humboldt (Humboldt-Alumuni-Preis) devido ao engajamento na cooperação acadêmica Brasil-Alemanha. É Professor Titular e Diretor da Faculdade de Filosofia e Ciências Humanas da PUCRS, atuando, na graduação e na pós-graduação, como Professor Permanente no PPG em Filosofia e no PPG em Direito da PUCRS. É Tradutor Público e Intérprete Comercial concursado para o idioma alemão. É bolsista de produtividade do CNPq e advogado.
