Some challenges to criminal law in risk society

Abstract

Criminal law faces a serious crisis in the context of risk society. This article analyzes the need for an acceptance of crimes of abstract danger, collective legal goods and the criminal liability of legal entities in order to protect future generations without jeopardizing the individual rights dating back to the Criminal Enlightenment.

Miguel Tedesco Wedy, Universidade do Vale do Rio dos Sinos

Possui graduação em Ciências Jurídicas e Sociais pela Pontifícia Universidade Católica do Rio Grande do Sul (1999) e mestrado em Ciências Criminais pela Pontifícia Universidade Católica do Rio Grande do Sul (2002). Atualmente é professor da Escola Superior da Magistratura do Rio Grande do Sul, advogado - Escritório de Advocacia Wedy Advogados, professor assistente da Universidade do Vale do Rio dos Sinos. É doutor em Direito pela Faculdade de Direito da Universidade de Coimbra. Tem experiência na área de Direito, com ênfase em Direito Penal, atuando principalmente nos seguintes temas: direito, penal, prisão, processo penal e princípio. É Coordenador Executivo do Curso de Direito da Unisinos.
