In view of the emergence of new transnational and globalized scenarios and the exhaustion of freedom as the paradigm of law in modernity, the aim of this paper is to establish some scientific and theoretical elements related to the need to consider the emergence of a new paradigm for law. The text shows that in the postmodern era sustainability may become the new paradigm of law, together with freedom, because, in addition to its vocation to be applied on a global scale, it presents a significant operational flexibility to accommodate the dialectics of various social forces, linking through a harmonizing discourse diverse values and interests.
Key words: paradigm of law, freedom, post-modernity, sustainability, transnationality.Downloads
