The systemic development of the environment law sense

Any discussion about the level of environmental protection in a particular Law System has as a precondition the observation of the attributed sense of environment as a legally protected interest. Therefore, the simultaneous description and evaluation of the formation of an environmental legal sense by the Law can provide key elements about the high level of its legal protection in the Brazilian Law System. The deepening environmental regulation is caused by the sense of environment produced by the legal common sense which includes functionally specialized and differentiated aspects. The present work aims to present descriptions of the formation of a dogmatic environmental legal sense by applying non-dogmatic theories.
