From the concept to the rule of law: the Kramer–Postema debate

Abstract

In this essay, my main goal is to present an important debate in contemporary jurisprudence: the debate between Matthew Kramer and Gerald Postema about the conditions for law itself to exist as a distinctive system of Governance and the demands of legality. Since the debate resonates some of the theses that were first presented by Lon Fuller in The Morality of Law, I also seek to present them in general terms and then defend what seems to me to be their best, most adequate interpretation. This way, drawing precisely upon Fuller’s work — contextualised and correctly understood —, I seek to articulate a defence of Postema’s arguments about the existence and rule of law.
