Oliveira Vianna and the reception of American legal realism: notes on a forgotten debate

Abstract

Abstract: The present investigation seeks to shed light on Oliveira Vianna's reception of notions of American legal realism during the Vargas Regime. This is a question that has demanded critical analysis, and the research seeks to point out the pioneering nature of this conceptual appropriation, highlighting the use and readjustment of the theories of jurists such as Karl Llewellyn and Jerome Frank in the Brazilian context. At the end, other doctrines that deal with a realist reading of Brazilian Law, such as Francisco Campos, Anor Butler Maciel and Monte Arraes, are retrieved and compared with Oliveira Vianna's reading of this phenomenon.
