Inovação na gestão de conflitos do Brasil: a importância da difusão prática e do conhecimento sobre as formas consensuais de resolução de conflitos

Abstract

The Judiciary Branch is the most sought-after structure for conflict resolution in Brazil. However, there are indications that most lawsuits could be resolved by consensual forms of dispute resolution. In this scenario, the reasons why Alternative Means of Conflict Resolution (MASCs) have not yet become popular in the country are questioned. The initial hypothesis resides in the lack of knowledge by society and legal professionals. Thus, we aim to understand the current context of judicial and extrajudicial conflict management in Brazil; verify the applicability of the forms of extrajudicial resolution in face of the most recurrent demands; assess the degree of knowledge of society and the adequate training of legal professionals on the consensual forms of resolution; and analyze whether there is a relationship between the MASCs and the improvement of Justice. For this purpose, we used quantitative and qualitative research, with bibliographic and documental review, including official data from the National Council of Justice (CNJ), the Association of Magistrates of Brazil (AMAB), the World Justice Project (WJP) and curriculum matrices of sample of the Bachelor of Law Courses. The results confirmed the initial hypothesis that society lacks sufficient knowledge and better training for legal professionals.
