Protection of social rights: Challenges of the South American ius commune

This paper discusses social rights by focusing on their protection in the international and regional context. It describes and analyzes the difficulties and challenges of the implementation of social rights in South America with the aim of building a regional constitutionalism whose foundation is the ius commune. For this purpose, the article presents the historical background of the affirmation of human rights and social rights as well as structural notions of the systems of their protection both at the global level and regional level in order to provide within the latter, especially in the South America, the challenges of the ius commune.
