Protection of social rights: Challenges of the South American ius commune

Abstract

This paper discusses social rights by focusing on their protection in the international and regional context. It describes and analyzes the difficulties and challenges of the implementation of social rights in South America with the aim of building a regional constitutionalism whose foundation is the ius commune. For this purpose, the article presents the historical background of the affirmation of human rights and social rights as well as structural notions of the systems of their protection both at the global level and regional level in order to provide within the latter, especially in the South America, the challenges of the ius commune.

Possui graduação em Direito pela Pontifícia Universidade Católica de São Paulo (1990), mestrado em Direito pela Pontifícia Universidade Católica de São Paulo (1993) e doutorado em Direito pela Pontifícia Universidade Católica de São Paulo (1996). Atualmente é professora doutora da Pontifícia Universidade Católica do Paraná; professora doutora da Pontifícia Universidade Católica de São Paulo; professora de Direitos Humanos dos Programas de Pós Graduação da Universidade Pablo de Olavide (Sevilha, Espanha) e da Universidade de Buenos Aires (UBA); visiting fellow do Human Rights Program da Harvard Law School (1995 e 2000), visiting fellow do Centre for Brazilian Studies da University of Oxford (2005), visiting fellow do Max Planck Institute for Comparative Public Law and International Law (Heidelberg - 2007 e 2008), sendo atualmente Humboldt Foundation Georg Forster Research Fellow no Max Planck Institute (Heidelberg - 2009-2011); membro do Conselho de Defesa dos Direitos da Pessoa Humana; membro da UN High Level Task Force on the implementation of the right to development; e membro do OAS Working Group para o monitoramento do Protocolo de San Salvador em matéria de direitos econômicos, sociais e culturais.Tem experiência na área de Direito, com ênfase em Direito Constitucional, atuando principalmente nos seguintes temas: direitos humanos, direito constitucional, direito fundamental, proteção internacional e proteção constitucional e internacional.
