Accusations, “fake” news and criticism in the STF’s censorship of Crusoé website

This article evaluates the censorship promoted by the Brazilian Federal Supreme Court against the websites Crusoé and O Antagonista, which had been accused of publishing fake news against the president of this court. The question is whether it is possible to classify as “fake news” the disclosure of information contained in court proceedings (as was the case), and whether it is legitimate for the judiciary to intervene by removing such publications. This article seeks to assess the impact of this censorship case, considering how the contradictory fake news concept may have been used politically to remove content that STF ministers considered to be a threat or an annoyance. The methodology adopted involves the analysis of the argument in a free speech legal case and its’ press repercussion , considering how this prohibition seeks to distinguish – with a problematic efficiency – from censorship.
