Functioning of open spaces for comments on news published by Brazilian and Portuguese newspapers in relation to regulation, participation principles and sanctions against who infringes them is described herein. Specificities, functions and relations among the mediatic systems (Luhmann, 2005, 2009) – sites and profiles of newspapers on Facebook are also problematized. For that, a group of significant reports are analyzed (Verón, 2004, 2013): terms and conditions of use published by the newspapers, besides fragments of interviews done with editors, in which the regulations and the functioning of these systems are problematized. It is noted that periodicals institute singular rules so that their publics may be a part of their institutional locus, as well as enunciate the penalties for their noncompliance as a participation disciplinary action. Nevertheless, if the newspapers have certain interference upon their sites, the same does not occur regarding their Facebook profiles, since this mediatic system imposes specific regulations.
Keywords: mediatic system, regulation, comments.
